As a self-managed 98 Unit community governed by its HOA Controlling Documents (Covenants & Restrictions, or C&R and Policy/Rules), Trails South Forty has specific guidelines and requirements that all homeowners must adhere to.  Many new homeowners may be unaware of these HOA obligations, as this information may not communicated by their real estate professionals prior to purchase.
To ensure that prospective buyers are fully informed, please be aware of the following:
Key Points for Realtors and Attorneys

1. Controlling Documents (C&R) and Policy/Rules: Before closing, buyers should be made aware that they are purchasing a home in a governed community. A copy of the Controlling Documents (Covenants & Restrictions & Policy/Rules) should be provided to the buyer prior to closing to ensure they understand the community’s rules, including:
   • Quarterly dues
   • Architectural control and guidelines
   • Landscaping and grounds management
   • Parking regulations
   • Tree removal
   • Irrigation Sprinkler systems
   • Homeowner’s insurance requirements
2. Reviewing the C&R/Policy Rules: Buyers should have the opportunity to review the C&R document and Policies/Rules before closing to fully understand the community’s requirements. This will prevent any confusion or unexpected surprises after the purchase.
3. Copy of the C&R Document: Please make sure your company receives a copy of the Controlling Documents from the seller to share with the interested buyer. If the seller does not have a copy it can be obtained on this website under Homeowners Page.

Required Documents and Items for Transfer at Closing
When a new owner takes possession of a property in Trails South Forty, the following items must be transferred to them at closing:

• C&R Documents
• Trails South Forty Policies and Rules
• Exterior Home Standards
• Insurance Declaration Page
• Mailbox Keys – Fee Varies: (Previous owner should provide or can be purchased from USPS Local Office)
• Pool Keys – Fee: $50 deposit  (Request from HOA BOD)
• Orientation Meeting -  Scheduled with new homeowners upon move-in
